Terms of Use

These Terms of Use ("Terms") are the agreement between you and BE PLUS S.R.L. ("we", "us", "our") for the BomberzBoard mobile game (the "App"). They also serve as the end user licence agreement for the App.

They cover both editions, which are the same game on the same backend:

By downloading, opening or playing the App you accept these Terms. If you do not accept them, do not use the App.

The three things worth knowing before you spend anything

Everything you buy is used inside the game. Fuel, medals, insignia, Battle Pass tiers, skins and frames exist only in your account. They are not money, they cannot be cashed out, sold or transferred, and they have no value outside the App.

We take no payments ourselves. Every purchase goes through Apple or Google. Refunds follow that store's policy, and a subscription is cancelled in that store's account settings, not here.

The game changes. It is a live service: content, prices, balance and features move over time, and a feature you rely on may be altered or withdrawn. Anything you have already bought and received stays credited to your account for as long as your account exists and the App is operated.

1. Who may play

You must be at least 13 years old, or the minimum age of digital consent in your country if that is higher (16 in some EU member states), to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian, who accepts these Terms on your behalf.

The App is not directed at children under 13 and we do not knowingly collect personal data from them. See the Privacy Policy for what we collect and why.

2. Your licence to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial entertainment.

This licence does not transfer ownership of anything. The App, its code, artwork, sound, text and the BomberzBoard name remain ours or our licensors'. The interface icon families bundled with the App are used under their own open-source licences, reproduced in full inside the App under Settings.

You may not: copy, modify, translate, reverse engineer, decompile or disassemble the App except to the extent that applicable law expressly permits it despite this restriction; rent, lease, lend, sell or sublicense it; remove or obscure any notice in it; or use it to build a competing product.

3. Accounts and callsigns

You can play without signing in: on first launch the App creates an anonymous account for your device. Signing in (with Apple on iOS, with Google on Android) is optional, and its purpose is to keep your progress attached to you rather than to one device — which is also why purchases can only be credited to a signed-in account.

Your callsign is generated by our server in a fixed form, such as Rookie-1a2b. The App has no field anywhere that accepts free text from a player: no chat, no messages, no comments, no uploads, no custom display names. This is deliberate, and it is why there is no user-generated content to moderate.

You are responsible for the security of the Apple ID or Google account you sign in with. You may delete your account and the data attached to it at any time from Settings in the App; deletion is permanent and removes your progress and any unspent virtual items.

4. Purchases

The App offers optional purchases. Some are one-time (consumables such as fuel packs, or unlocks such as a skin); some are subscriptions that renew automatically.

Payment is handled entirely by Apple or Google. We never see or store your card details. The price shown in the App is the price that store charges in your country, including any taxes it collects, and it is shown in full before you confirm.

Refunds are that store's decision, under that store's policy. We cannot issue, reverse or guarantee one. Apple: reportaproblem.apple.com. Google: your Google Play order history.

Subscriptions renew until you cancel. The renewal period and price are shown on the purchase screen before you buy. The subscription renews at the end of each period unless you turn off auto-renewal at least 24 hours before it ends, in your Apple ID or Google Play account settings. Cancelling stops the next renewal; the period you have already paid for runs to its end. Uninstalling the App does not cancel a subscription.

What a subscription grants is listed in full on its purchase screen, and everything it grants is in-game content. If we change what a tier includes, the change applies from your next renewal, and we will tell you before it takes effect.

5. Virtual items and in-game currency

Fuel, medals, insignia, scans, Battle Pass tiers, skins, frames and every other in-game item are a licence to use them inside the App. They are not money, credit, a deposit, a security, or property. They cannot be redeemed for cash, exchanged, gifted outside the mechanisms the game itself provides, transferred between accounts, or sold.

We may add, change, rebalance, reprice or retire virtual items, and we may change how much of an item an activity awards. This is ordinary live-service maintenance and is not a refundable event by itself. Items you have already bought and received remain credited to your account.

Offers with a stated duration end when they say they do. Where the game shows you an amount before a purchase — for example an accumulated total that a purchase pays out — the amount our server credits is the amount that was displayed at that moment.

Your balance ends when your account does: if you delete your account, or if we close it under section 7, unspent items are gone and are not compensated.

6. Fair play

BomberzBoard is a competitive game with public rankings, so the rules exist to keep a match honest. You agree not to:

Our server is the authority on your progress, your balances and the outcome of a match. Where the App and the server disagree, the server is correct.

7. Suspension and termination

You may stop using the App at any time, and delete your account from Settings.

We may suspend or close an account that breaks section 6, that is used to abuse purchases or refunds, or where we are required to by law. Where it is reasonable and lawful to do so, we will tell you why and give you a way to reply. A closure for cause does not entitle you to a refund of items already consumed.

We may also stop operating the App altogether. If we do, we will give reasonable public notice, and we will handle any unexpired subscription in line with the store's policy and applicable consumer law.

8. Advertising

The App shows advertising, including optional rewarded video you choose to watch in exchange for in-game items, and promotional slots for our own other apps. An active Commander VIP or VIP+ subscription removes that advertising, which is part of what the subscription is for: you receive the rewards without watching a video. 9. Your rights as an EU or UK consumer

Nothing in these Terms limits rights you have under mandatory consumer law, and if a term here conflicts with such a right, that right wins.

The 14-day right of withdrawal. For digital content and services bought in the EU or UK you normally have 14 days to withdraw. Where a purchase is delivered into your account immediately, you are asked to consent to immediate delivery and you acknowledge that you lose the right of withdrawal once delivery has begun — that consent is part of the store's purchase flow, not ours. For a subscription, the withdrawal right applies as the store presents it at purchase, and any amount due back is calculated pro rata for the part of the period not yet used.

Legal guarantee. If the App or something you bought in it is faulty or does not match what was described, you are entitled to have it brought into conformity, or to an appropriate reduction or refund, under the law of your country.

Dispute resolution. Write to us first at support@bomberzboard.com. We are not obliged to take part in dispute resolution before a consumer arbitration body.

10. Availability, and what we do not promise

The App needs an internet connection for multiplayer, purchases and progress. We aim to keep it available, but we do not promise it will be uninterrupted or error-free: a match can be lost to a network drop, and maintenance or an outage can make the game unavailable.

To the extent the law allows, the App is provided "as is" and we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. Consumers keep the rights described in section 9, which this paragraph does not affect.

11. Our liability

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, and to the extent the law allows: we are not liable for indirect or consequential loss, for lost profits, business or data, or for the loss of virtual items where it results from something outside our reasonable control; and our total liability to you for any claim relating to the App is limited to the greater of the amount you paid for the App and for purchases in it in the twelve months before the claim, or EUR 50.

12. Changes to these Terms

We may update these Terms as the game changes or the law does. The current version always lives at bomberzboard.com/terms.html, with the effective date at the top. Where a change materially reduces your rights or adds an obligation, we will give notice in the App or by the contact details attached to your account before it takes effect. Continuing to use the App after a change takes effect means you accept the updated Terms; if you do not, stop using the App and, if you wish, delete your account.

13. App store terms that also apply

The store you downloaded from has its own terms, and they apply alongside these.

iOS. These Terms are between you and BE PLUS S.R.L. only, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide support for the App. If the App fails to conform to any warranty we cannot disclaim, you may notify Apple and Apple will refund the purchase price of the App itself; to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claim that the App or your use of it infringes intellectual property rights, and for product liability and consumer-protection claims relating to the App, to the extent these Terms do not validly disclaim them. You confirm you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Android. The Google Play Terms of Service apply to your download and to purchases made through Google Play.

14. General

These Terms, with the Privacy Policy, are the whole agreement between us about the App. If a court finds any part unenforceable, the rest stays in force. Our not enforcing a term is not a waiver of it. You may not assign these Terms; we may assign them to a successor of our business, without reducing your rights.

These Terms are governed by Romanian law. If you are a consumer, you also keep the protection of the mandatory law of the country you live in, and you may bring proceedings in your own courts.
